Using an oxygen inhaler while fasting
 
Q. A brother has to inhale oxygen whenever he sleeps. The oxygen has to be inhaled by him as long as he is sleeping. He cannot sleep without oxygen. This procedure is permanent. Now, does this oxygen inhaling break his fast or not? As you know oxygen is only air. He says there is no medication mixed in it. Please reply asap?

A. In the above referred, we have consulted a doctor. We are advised that the oxygen contains only air and does not contain any form of medication. As such, the oxygen inhaled does not nullify ones fast. (Mabsoot 3/93)

Taking an Injection whilst Fasting

 

Q: Is it permissible for a person to take an injection whilst fasting and will the fast be nullified?

A: It is permissible for a person to take an injection whilst fasting. The injection does not nullify the fast. However, in the case where the injection is directly injected into the stomach or brain the fast will be nullified. (Fataawa Mahmoodiyyah vol.15 pg.180/181, Ahsanul Fataawa vol.4 pg.432, Fataawa Raheemiyyah vol.7 pg.257,263)

والذي ذكره المحققون أن معنى المفطر وصول ما فيه صلاح البدن إلى الجوف أعم من كونه غذاء أو دواء (رد المحتار على در المختارج2 ص410

Use of eye-drops, ear-drops and nose-drops whilst fasting
 

Q: Is it permissible to use eye-drops, ear-drops and nose-drops whilst fasting and will they nullify the fast?

 

A: It is permissible to use eye-drops whilst fasting. The fast will not be nullified. However, using ear-drops and nose-drops whilst fasting is impermissible and will nullify the fast. (Fataawa Raheemiyyah vol.7 pg.246, Fataawa Mahmoodiyyah vol.15 pg.167/168, Ahsanul Fataawa vol.4 pg.439)

(أو ادهن أو اكتحل أو احتجم) وإن وجد طعمه في حلقه قال في الشامية : أي طعم الكحل أو الدهن كما في السراج و كذا لو بزق فوجد لونه في الأصح بحر قال في النهر لأن الموجود في حلقه أثر داخل من المسام الذي هو خلل البدن والمفطر إنما هو الداخل من المنافذ (رد المحتار على در المختار ج2 ص395)

(أو احتقن أو استعط) في أنفه شيئا (أو أقطر في أذنه دهنا …) فوصل الداء حقيقة إلى جوفه أو دماغه (در المختار ج2 ص402)

ولو أقطر شيئا من الداء في عينه لايفطر صومه عندنا وإن وجد طعمه في حلقه وإذا بزق فرأى أثر الكحل ولونه في بزاقه عامة المشايخ على أنه لايفسد صومه كذا في الذخيرة وهو الأصح كذا في التبيين (الفتاوى الهندية ج1ص203)

Bleeding Gums whilst Fasting

 

Q: Whilst fasting, if the gums begin to bleed and the blood flows down the throat will the fast break? If so will both Qadha and Kaffarah be Waajib or only Qadha?

 

A: If the blood which was swallowed with the saliva was more than the saliva or equal to it then the fast will break and only qadha will be waajib. If the blood was less than the saliva then the fast will not break. (Ahsanul Fataawa vol.4 pg.436, Fataawa Raheemiyyah vol.7 pg.258, Bahishti Zewar vol.3 pg.13)

 

ولو أكل دما في ظاهر الرواية عليه القضاء دون الكفارة لأنه مما يستقذره الطبع كذا في الظهيرية، الدم إذا خرج من الأسنان ودخل حلقه إن كانت الغلبة للبزاق لايضره وإن كانت الغلبة للدم يفسد صومه وإن كانا سواء أفسد أيضا استحسانا(الفتاوى الهندية ج1 ص203)

خرج الدم من بين أسنانه ودخل حلقه يعني ولم يصل إلى جوفه أما إذا وصل فإن غلب الدم أو تساويا فسد وإلا لا … قال الشامي: قلت ومن هذا يعلم حكم من قلع ضرسه في رمضان ودخل الدم إلى جوفه في النهار ولو نائما فيجب عليه القضاء (رد المحتار على در المختار ج2 ص396)

Eating Forgetfully whilst Fasting
 
 
Q: If a person forgetfully eats whilst fasting does his fast break?
 
 
A: The fast will not break by forgetfully eating or drinking. (Bahishti Zewar vol.3 pg.10/11)
 
(إذا أكل الصائم أو شرب أو جامع) حال كونه (ناسيا) في الفرض والنفل (در المختار ج2 ص394)
 
(إذا أكل الصائم أو شرب أو جامع ناسيا لم يفطر ولا فرق بين الفرض والنفل كذا في الهداية (الفتاوى الهندية ج1ص203)

Applying Vicks while fasting
 
Q. I was told that the applying of vicks whilst fasting breaks the fast as it enters the head and brain by using it. And if anything enters the stomach, head and brain whilst fasting, it will break the fast? Is this correct?
 
A. In principle, if the things that breaks ones fast reaches ones brain or stomach through the main channels of the body i.e. the mouth, nose, front or back passage it will nullify ones fast.
 
In the enquired case, by applying vicks on the head, the actual vicks does not reach the brain. The vicks merely has an effect on the brain. As such, if a person applies vicks on the head and it has an effect of the brain, the fast will not be nullified. (Badaai’-us-Sanaai’ 2/93)

The Rules of Ramadan – Mufti Muhammad Shafi

 

The following is a short work on the rules and etiquettes pertaining to the Holy month of Ramadan in the Islamic calendar.  It was initially compiled by the late Grand Mufti of Pakistan, Muhammad Shafi (the father of Mufti Taqi Usmani).  It was translated by Shaykh Muhammad bin Moulānā Harūn Abasoomar from South Africa.

 

The following is his introduction:

 

The Rules of Ramadan, a translation of أحكام رمضان authored by Mufti Muhammad Shafi Usmani (ra).

 

In this concise booklet the Honourable Muftī Muhammad Shafi Sahib (r.a.) has outlined the very basic rules of the blessed month of Ramadān. These rules are undoubtedly very pertinent and important. It is hoped that the reader studies this booklet prior to and during the blessed month of Ramadān.

 

In conclusion we have included some questions and answers pertaining to the various aspects of Ramadān. These have been adapted from the ask- imām.com website which is the official website of the Iftā department of the Madrasah.  We hope to update this section with other references in future editions – Insha Allāh-.

 

An index has also been added so that the reader may locate his query easily.

 

We make du’ā to Almighty Allāh that He accepts this humble effort towards educating the ummah of His beloved Prophet Muhammad sal allahu `alayhi wa sallam and that He makes it a means of our success in both the worlds. Amīn.

Ghusl for conjugal relations after Sehri
 
Q. Is it permissible for a person have conjugal relations with his wife before Sehri and take a bath after Sehri? 
 
A. It is permissible for husband and wife to engage in conjugal relations from sunset until Subah Sadiq (true-dawn). Hence, it will be permissible for husband and wife to engage in conjugal relations before Subah Sadiq (true-dawn) and take a Ghusal after Subah Sadiq (true-dawn). However, one should take a Ghusal as soon as possible so that Fajr in the Masjid is not missed. (Al-Bahrur-Raa’iq 2/293)

Fasting without Intention
 
Q: I did not have an intention to fast the Ramadaan fast today so I did not wake up for sehri but I did not eat anything for the day. During the course of the day my intention is to fast. Can I still fast or not?

 

A: If you had not eaten anything since sehri time, then you are allowed to make an intention and start fasting. However, the intention must be made at one hour  before zawaal. Furthermore, when making the intention, intend that you are fasting from subuh saadiq (i.e. dawn)
 
Find out from your local musjid what time is zawaal in your area. If you had made the intention one hour before, your fast will be valid.

Frequently asked Questions pertaining to Fasting (Part 1)
 
 
Q: Does a minor child have to fast?
A: fasting is not obligatory on a child.
 
Q: Does a pregnant woman have to fast?
A: By default, a pregnant woman has to fast. However, if illness or harm is genuinely feared upon herself or the foetus, she is then exempted from fasting. She will have to do Qadhā’ later.
Q: Does a sick person have to fast?
A: A sick person is exempted from fasting altogether if there is genuine reason to believe that the current illness will intensify by fasting or that he will suffer another illness on result of fasting or that his recovery will be prolonged due to fasting.
Q: Can a traveller omit fasting?
A: A Shar’ī musāfir (traveller) who embarked on his journey prior to dawn is permitted to omit the fast of that day. As long as he is a Shar’ī musāfir, he may omit fasting.
Q: What about travelling during the day?
A: If a person embarked on a journey during the day, he/she will have to fast that day.
Q: Will the application of eye drops break the fast?
A: Using eye drops will not break the fast.
Q: Can ear drops be used?
A: If a person’s eardrum is not perforated (intact), he may use ear drops. If someone has perforated ear drums, it will not be permissible to use ear drops.
Q: Can we use insulin injections whilst fasting?
A: It is permissible to use insulin injections. Injections do not break a fast.
Q: Will a nasal spray break the fast?
A: Yes, a nasal spray will break the fast.
Q: Can mouthwash be used whilst fasting?
A: It is disliked to use mouthwash whilst fasting.
Q: Is it permissible to brush teeth and use toothpaste?
A: It is disliked to use toothpaste whilst fasting. One may brush teeth, use a miswak and a tongue scraper.
Q: Can an addicted smoker smoke whilst fasting?
A: It is not permissible to smoke whilst fasting. Smoking will result in Qadhā and Kaffārah. A smoker may use a transdermal nicotine patch.
Q: What is the ruling for using suppositories?
A: Insertion of suppositories up the rear passage will invalidate the fast.
Q: I forgetfully ate whilst fasting?
A: If one was totally unaware that he was fasting, the fast will not be broken regardless of what was consumed.
Q: By mistake I swallowed water whilst doing wudhu?
A: By doing an act mistakenly will break one’s fast. However, only Qadhā will be necessary.
Q: I engaged in intercourse with my spouse?
A: Intercourse will invalidate the fast and will make Qadhā and Kaffārah compulsory.
Q: will engaging in intimacy break the fast?
A: Merely being intimate is disliked if it will lead one further. If one experiences ejaculation, the fast will be broken.
Q: I had a wet dream whilst fasting. Is my fast broken?
A: A wet dream will not invalidate the fast.
Q: What is the Kaffārah?
A: A Kaffārah is expiation for a violation. It is fasting for 60 days consecutively without any interruption for those capable of fasting. If one cannot fast, he will have to give monetary Kaffarah.
Q: When will Kaffārah be binding?
A: By swallowing food without an excuse, consuming something that one is inclined to or by intercourse.
Q: Can a sick person pay fidyah instead of fasting?
A: A person who cannot fast due a chronic or terminal illness may give fidyah. As long as a person’s condition remains such that they cannot fast, they will keep giving fidyah for each fast.

What is the status of Sehri in Ramadaan?
A. Sehri is a Sunnah practice. Rasulullah Sallallaahu Alayhi Wa Sallam is reported to have said, ”Partake of Sehri, for verily there is Barakah (blessings) in Sehri.” (Bukhari, Muslim) However the fast is valid without Sehri.
 
Does the use of an injection break the fast?
A. The fast is not nullified. However if the injection is injected directly into the stomach or brain, the fast would break. (Ahsanul Fatawa, V: 4, P: 432).

NB. Dosages of Insulin injected to the abdomen does not invalidate the fast as it is not injected directly into the stomach.
 
Does the use of a drip break the fast?
A. No. (Fataawa Mahmoodiya, V: 10, P: 149, Farooqiyyah).
Can I have a blood test done whilst fasting?
A. Yes, you could do so provided that you do not become so weak that fasting becomes difficult. (AhsanulFatawa, V: 4, P: 435, Sa’eed)
If one vomits, does it break the fast?
A. The fast is only broken if one had vomited a mouthful involuntarily and swallowed it voluntarily or if one had voluntarily (induced) vomited a mouthful whether swallowed or not. (al-Fataawa al-Hindiyyah– V: 1, P: 203/4)

The definition of “mouthful (vomit)” is that which one cannot hold back in one’s mouth without difficulty.
 
Is it permissible to swim whilst fasting?
A. It is not advisable to swim whilst fasting. If water is swallowed by mistake or enters through the nose and reaches the brain then the fast will break and a Qadha will have to be kept. (Tahtaawi Alaa Maraqil Falaah, P: 671)
Is it permissible to apply oil to the head whilst fasting?
A. Yes it is permissible to do so. (al-Fataawa al-Hindiyya– V: 1, P: 203)
I am writing exams during Ramadaan and find it difficult to concentrate whilst hungry. Can I delay my fast until after Ramadaan?
A. It is not permissible to do so. Keep your fast and pray to Allah Ta’ala to make it easy for you.(Fataawa Raheemiya V: 2. P: 34)
I am an asthmatic. Does the usage of the pump break my fast?
A. It is advisable that you use your pump at Sehri time and Iftaar time. However, if you do have an acute attack, you could use your pump. This will break your fast however.
Will my fast break if my nose bleeds?
A. No, the fast is not broken by mere nosebleed. However if blood flows down the throat, it will break if one tastes the blood in the throat or the blood swallowed is more or equal to the saliva swallowed with it. If the blood is less than the saliva, the fast is still intact. (al-Fataawa al-Hindiyyah– V:1, P: 203)
Can one take a bath after Sehri, to be cleared from the state of Janaabat (requiring Fardh Ghusal)?
A. It is not advisable to unnecessarily delay the Fardh Ghusl. However if one is the position that he wants to partake of Sehri before taking the Ghusl then it is permissible.
If one is fasting and sprays perfume on oneself and accidentally inhales some of the perfume, will it break the fast? Will Qadha have to be made?
A. One’s fast does not break by wearing, feeling or smelling fragrance. As such, it is permitted to apply perfume (itr) whilst in the state of fasting. However, if one was to intentionally inhale something that has a perceptible body, such as smoke (like the smoke of lobaan, the vapour of perfumes, agharbatti, Oudh etc.), then one’s fast would become invalid. (Tahtawi ala Maraqil Falaah, P:660)
Does masturbating break the fast?
A. One is not allowed to masturbate, whether fasting or not. However if one does this vile act whilst fasting then the fast will break and a Qadha will have to be kept. (Raddul Muhtaar, V:. 2, P: 399)

NB: One should make sincere and abundant Taubah for this debase act.
 
Is it permissible for a husband and wife to kiss whilst fasting?
A. It is permissible, provided that:

i. One does not swallow the saliva of his/her partner.
ii. One has control over his/her desire and is not driven by desire to sexual intercourse or ejaculation.
(Raddul Muhtaar, V: 2, P: 410)

However such an action in the state of fasting is not advisable. If the saliva of the spouse is swallowed then not only is Qadha to be made but also Kaffaarah (i.e. fasting consecutively for 60 days).
 
Q. I am a diabetic and not in a position to keep fast. How do I compensate for the missed fasts?
A. Allah Ta’ala has granted permission to people like yourself to compensate the fast with contributions for poor Muslims. The Jurists have equated this amount to that of Sadaqatul Fitr (money given on Eid day to the poor). The current (Ramadhaan 1438) price in KwaZulu-Natal, South Africa is R20.00 or more for each fast. It could be paid at the beginning of Ramadhan or at the end. (Shaami). This money may not be discharged before Ramadaan.

MINT FLAVOURED MISWAAK – WILL USING IT INVALIDATE MY FAST?

 

QUESTION:

I most of the time use mint flavoured miswaak, can I still use this in ramadan or will it invalidate my fast. 

 

ANSWER:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

 

The mint flavour in a flavoured miswak is added to the miswak and is not the natural flavour of a miswak[1]. Tasting anything without a valid Shar’i reason while fasting is makrooh (disliked) and therefore should be avoided while fasting. There is also a possibility that the flavour may go beyond ones throat risking the validity of ones fast [2].

Fasting for one Commencing a Journey in Ramadhaan

 

Q: A person intends travelling during the course of the day and at the time of Subah Sadiq (when the fast commences) he is still in his hometown? Is it permissible for him not to fast?

A: It is compulsory for a person who is present in his hometown at the time of Subah Sadiq to fast. Since he only intends travelling during the course of the day the concession of not fasting does not apply to him. Hence, if he does not keep the fast he will be sinful.

ومنها السفر الذي يبيح الفطر وهو ليس بعذر في اليوم الذي أنشأ السفر كذا في الغياثية فلو سافر نهارا لايباح له الفطر في ذلك اليوم وإن أفطر لا كفارة عليه بخلاف ما لو أفطر ثم سافر كذا في محيط السرخسي (الفتاوى الهندية ج1 ص206)

(وللمسافر الذي أنشا السفر قبل طلوع الفجر إذ لايباح له الفطر بإنشائه بعد ما أصبح صائما بخلاف ما لو حل له مرض بعده فله (الفطر) لقوله تعالى فمن كان منكم مريضا أو على سفر فعدة من أيام أخر … (وصومه) أي المسافر (أحب إن لم يضره) لقوله تعالى: ,أن تصوموا خير لكم (مراقي الفلاح ص686)

BREAKING FAST AFTER EMBARKING ON A JOURNEY

Question:

When one has done Shehri and has intention to fast and is on Fardh fast and then later in the day, he embarks on a journey. Does he have the option of breaking the fast in Safar on that day ? And if he breaks the fast on that day in safar, is it Gunaah 

 

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Shariah has granted concession for a person not to fast if he is a musafir at the time of Subah Saadiq (true dawn)

If he undertakes a journey of 48 miles or more after Sehri time, he will have to continue his fast. It is not permissible for him to break his fast. If he does so, he will be sinful. He will have to make Qadha (make up) for the broken fast. There is no Kaffarah for breaking such a fast. However, the person must repent for his sinful act and make Istighfaar.

والشيخ الفاني إذا كان لا يقدر على الصوم

وأصله قوله تعالى { فمن كان منكم مريضا أو على سفر فعدة من أيام أخر }

ثم السفر المبيح للفطر هو السفر المبيح للقصر وهو مسيرة ثلاثة أيام ولياليها سير الإبل ومشي الأقدام

ويستوي الجواب بين أن يسافر قبل رمضان وبين أن يسافر بعد دخول رمضان

سافر بعدما أهل في الحضر هلال رمضان

والصحيح قول عامة الصحابة وعامة العلماء لأن النص مطلق وهو قوله تعالى { أو على سفر } وكذلك الداعي إلى الرخصة وهو المشقة عام شامل

مراقي الفلاح شرح نور الإيضاح (ص: 258)

وللمسافر" الذي أنشأ السفر قبل طلوع الفجر إذ لا يباح له الفطر بإنشائه بعد ما أصبح صائما بخلاف ما لو حل به مرض بعده فله "الفطر"

Does acid reflux break the fast?
 
Q. I have reflux in pregnancy  but I'm trying to fast today and it's already came up my throat twice. will my fast be accepted?

A. An Acid reflux occurs when part of the stomach contents travels back up the oesophagus (sometimes into the throat and even into the mouth). Acid reflux happens unintentionally/involuntarily.
 
If one experiences acid reflux whilst fasting, the fast will only break if the contents enter the mouth and is then swallowed intentionally.
 
If the contents enter the mouth and is swallowed involuntarily or spat out, the fast will not break. (Kitaabul Fataawa 3/389)
 
In any event, the fast will not be effected if it does not reach the mouth or if it is not swallowed.
