  1. Q: If a dolphin dies in a a small pool, not bigger than 5 x 5 meters, does the water become impure? A: No, the water will not become impure. And Allah Ta'ala (الله تعالى) knows best. ( ويجوز ) رفع الحدث ( بما ذكر وإن مات فيه ) أي الماء ولو قليلا ( غير دموي كزنبور ) وعقرب وبق أي بعوض وقيل بق الخشب وفي المجتبى الأصح في علق مص الدم أنه يفسد ومنه يعلم حكم بق وقراد وعلق وفي الوهبانية دود القز وماؤه وبزره وخرؤه طاهر كدودة متولدة من نجاسة ( ومائي مولد ) ولو كلب الماء وخنزيره ( كسمك وسرطان ) وضفدع إلا بريا له دم سائل وهو ما لا سترة له بين أصابعه فيفسد في الأصح كحية برية إن لها دم وإلا لا ( وكذا ) الحكم ( لو مات ) ما ذكر ( خارجه وبقي فيه ) في الأصح فلو تفتت فيه نحو ضفدع جاز الوضوء به لا شربه لحرمة لحمه ( وينجس ) الماء القليل ( بموت مائي معاش بري مولد ) في الأصح ( كبط وإوز ) (الدر المختار 1/ 183) قال الشامي : قوله ( ومائي مولد ) عطف على قوله غير دموي أي ما يكون توالده ومثواه في الماء سواء كانت له نفس سائلة أو لا في ظاهر الرواية بحر عن السراج أي لأن ذلك ليس بدم حقيقة وعرف في الخلاصة المائي بما لو استخرج من الماء يموت لساعته وإن كان يعيش فهو مائي وبري فجعل بين المائي والبري قسما آخر وهو ما يكون مائيا وبريا لكن لم يذكر له حكما على حدة والصحيح أنه ملحق بالمائي لعدم الدموية شرح المنية أقول والمراد بهذا القسم الآخر ما يكون توالده في الماء ولا يموت من ساعته لو أخرج منه كالسرطان والضفدع بخلاف ما يتوالد في البر ويعيش في الماء كالبط والإوز كما يأتي قوله ( ولو كلب الماء وخنزيره ) أي بالإجماعة خلاصة وكأنه لم يعتبر القول الضعيف المحكي في المعراج أفاده في البحر قوله ( كسمك ) أي بسائر أنواعه ولو طافيا خلافا للطحاوي كما في النهر قوله ( وسرطان ) بالتحريك ومنافعه كثيرة بسطها في القاموس قوله ( وضفدع ) كزبرج وجعفر وجندب ودرهم وهذا أقل أو مردود قاموس قوله ( فيفسد في الأصح ) وعليه فما جزم به في الهداية من عدم الإفساد بالضفدع البري وصححه في السراج محمول على ما لا دم له سائل كما في البحر والنهر عن الحلية قوله ( كحية برية ) أما المائية فلا تفسد مطلقا كما علم مما مر وكالحية البرية الوزغة لو كبيرة لها دم سائل منية قوله ( وإلا لا ) أي وإن لم يكن للضفدع البرية والحية البرية دم سائل فلا يفسد قوله ( ما ذكر ) أي من مائي المولد وغير الدموي ط قوله ( لحرمة لحمه ) لأنه قد صارت أجزاؤه في الماء فيكره الشرب تحريما كما في البحر قوله ( القليل ) أما الكثير فيأتي حكمه بعد قوله ( في الأصح ) أي من الروايتين لأن له نفسا سائلة واتفقت الروايات على الإفساد في غير الماء كذا في شرح الجامع لقاضيخان فما في المجتبى من تصحيح عدم الإفساد به غير ظاهر نهر قوله ( كبط وإوز ) فسر في القاموس كلا منهما بالآخر فهما مترادفان والإوز بكسر ففتح وزاي مشددة وقد تحذف الهمزة (رد المحتار 1/ 184) Answered by: Mufti Zakaria Makada Checked & Approved: Mufti Ebrahim Salejee (Isipingo Beach)
  2. Q: I would like to know is the nikaah valid if the couples are not willing by heart? Especially the bride? If they just accept the nikaah because of family pressure. A: If consent is given by the girl for the nikaah to be performed, then the nikaah will be valid. However it is not at all correct for the family to force the girl to marry someone whom she is unhappy to marry. Generally, in forced marriages there is always the fear that the nikaah would not last on account of the spouses not being compatible. And Allah Ta'ala (الله تعالى) knows best. قال الشامي : قوله ( ليتحقق رضاهما ) أي ليصدر منهما ما من شأنه أن يدل على الرضا إذ حقيقة الرضا غير مشروطة في النكاح لصحته مع الإكراه والهزل رحمتي وذكر السيد أبو السعود أن الرضا شرط من جانبها لا من جانب الرجل واستدل لذلك بما صرح به القهستاني في المهر من فساد العقد إذا كان الإكراه من جهتها وأقول فيه نظر فإنه ذكر في النقاية أن في النكاح الفاسد لا يجب شيء إن لم يطأها وإن وطئها وجب مهر المثل فقال القهستاني عند قوله في النكاح الفاسد أي الباطل كالنكاح للمحارم المؤبدة أو المؤقتة أو بإكراه من جهتها الخ فقوله من جهتها معناه أنها إذا أكرهت الزوج على التزوج بها لا يجب لها عليه شيء لأن الإكراه جاء من جهتها فكان في حكم الباطل لا باطلا حقيقة وليس معناه أن أحدا أكرهها على التزوج ونظير هذه المسألة ما قالوه في كتاب الإكراه من أنه لو أكره على طلاق زوجته قبل الدخول بها لزمه نصف المهر ويرجع به على المكره إن كان المكره له أجنبيا فلو كانت الزوجة هي التي أكرهته على الطلاق لم يجب لها شيء نص عليه القهستاني هناك أيضا وأما ما ذكر من أن نكاح المكره صحيح إن كان هو الرجل وإن كان و المرأة فهو فاسد فلم أر من ذكره وإن أوهم كلام القهستاني السابق ذلك بل عبارتهم مطلقة في أن نكاح المكره صحيح كطلاقه وعتقه مما يصح مع الهزل ولفظ المكره شامل للرجل والمرأة فمن ادعى التخصيص فعليه إثباته بالنقل الصريح نعم فرقوا بأن الرجل والمرأة في الإكراه على الزنا في إحدى الروايتين ثم رأيت في إكراه الكافي للحاكم الشهيد ما هو صريح في الجواز فإنه قال ولو أكرهت على أن تزوجته بألف ومهر مثلها عشرة آلاف زوجها أولياؤها مكرهين فالنكاح جائز ويقول القاضي للزوج إن شئت أتمم لها مهر مثلها وهي امرأتك إن كان كفؤا لها وإلا فرق بينهما ولا شيء لها الخ فافهم (رد المحتار 3/ 21) فتاوى محمودية 16/ 239 Answered by: Mufti Zakaria Makada Checked & Approved: Mufti Ebrahim Salejee (Isipingo Beach)
  3. From the book Khulaasatul Kalaam by Shaykh Jaarullah 1. Fast Ramadhan with belief and truly seeking the reward of Allah the Most High so that He may forgive you your past sins. 2. Beware of breaking your fast during the days of Ramadhan without a valid Islamic excuse, for it is from the greatest of sins. 3. Pray Salat ut-Taraweeh and the night prayer during the nights of Ramadhan – especially on Layatul-Qadr – based on belief and truly seeking the reward of Allah, so that Allah may forgive you your past sins. 4. Make sure that your food, your drink and your clothing are from halal means, in order that your actions be accepted, and your supplications answered. Beware of refraining from the halal while fasting and breaking your fast with the haram. 5. Give food to some fasting people to gain a reward similar to theirs. 6. Perform your five prayers on time in congregation to gain the reward and Allahs protection. 7. Give a lot of charity for the best charity is that of Ramadhan. 8. Beware of spending your time without performing righteous deeds, for you will be responsible and reckoned for it and will be rewarded for all you do during your time. 9. Perform `umrah in Ramadhan for `Umrah in Ramadhan is equal to Hajj. 10. Seek help for fasting during the day by eating the sahoor meal in the last part of the night before the appearance of Fajr. 11. Hasten breaking your fast after the sun has truly set in order to gain the love of Allah. 12. Perform ghusl before fajr if you need to purify yourself from the state of major impurity so that you are able to do acts of worship in a state of purity and cleanliness. 13. Cease the opportunity of being in Ramadhan and spend it with the good that has been revealed in it – by reciting the noble Quran and pondering and reflection of its meanings so that it be a proof for you with your Lord and an intercessor for you on the Day of Reckoning. 14. Preserve your tongue from lying, cursing, backbiting and slander for it decreases the reward of fasting. 15. Do not let fasting cause you cross your boundaries by getting upset due to the slightest of reasons. Rather, fating should be a cause of peacefulness and tranquility of your soul. 16. Upon completion of fasting, be in a state of taqwa of Allah the Most High, being aware of Allah watching you in secret and in public, in thankfulness for His favors, and steadfastness upon obedience of Allah by doing all what He has ordered and shunning all that He has prohibited. 17. Increase in remembrance of Allah, seeking of forgiveness, asking for Paradise and protection against the Fire, especially when fasting, while breaking the fast and during suhoor, for these actions are among greatest causes of attaining Allahs forgiveness. 18. Increase in supplication for yourself, your parents, your children and Muslims, for Allah has ordered making of supplications and has guaranteed acceptance. 19. Repent to Allah with a sincere repentance in all times by leaving sins, regretting those that you have done before and firmly deciding not to return to them in the future, for Allah accepts repentance of those who repent. 20. Fast six days of Shawwal, for whoever fasts Ramadhan and then follows it with six days of Shawwal, it is as if he fasts all the time. 21. Fast on the Day of `Arafah, the 9th of Dhul Hijjah, to attain success by being forgiven your sins of the last year and the coming year. 22. Fast on the day of `Aashuraa, the 10th of Muharram, along with the 9th, to attain success by being forgiven your sins of the past year. 23. Continue being in a state of iman and taqwa and perform righteous actions after the month of Ramadhan, until you die. And worship your Lord until there comes to you the certainty (i.e. death). Ensure that you attain the positive effects of your acts of worship such as prayer, fasting, zakat and hajj, sincere repentance and leaving of customs that are in variance with the Sharee`ah. 25. Invoke a lot of salawat and salam upon the Messenger of Allah, may Allahs blessings and peace be upon him, his Companions and all those who follow them until the Day of Judgment. O Allah make us and all Muslims of those who fast and stand in prayer during the month of Ramadhan based on belief and truly seeking Your reward so that we are forgiven our past and future sins. O Allah make us of those who fasted the month, attained full reward, witnessed Layatul-Qadr and attained success by permission of the Lord, Blessed and Most High. O Allah, verily you are Forgiver, like to forgive, so forgive us. O Allah, accept from us, verily you are the All-Hearing, all-Seeing, O Living, O Independent, O Owner of all majesty and honor.   4. 1. Ask Allah to enable you to reach Ramadan and to get the most out of it as the Salaf (early generation of pious people) used to do. 2. Intend to fast every day with Iman and pure intention seeking the reward from Allah alone. The Prophet peace be upon him said, “Whoever fasts in Ramadan with Iman and seeking reward (from Allah) his past sins will be forgiven”. (Bukhari) 3. Read the whole Qur’an at least once as the Prophet peace be upon him did. 4. Have Suhoor as the Prophet peace be upon him said, “Have Suhoor because it is blessed”. 5. Make Du’a during the fast because the Prophet peace be upon him said that three people’s supplication is not rejected one of them is the fasting person. Ask for the good of this life and the next for yourself, your family and Muslims in general. 6. Make Dua before opening the fast. The Prophet peace be upon him said, “The fasting person has a supplication that is answered when he opens his fast”. 7. Give Sadaqah and be good to people. The Prophet peace be upon him was the most generous of people and he was most generous in Ramadan. 8. Avoid anything that diminishes the fast such as, lying, backbiting, cheating, getting angry. The Prophet peace be upon him said “Whoever does not give up false statements (i.e. telling lies), and evil deeds, and speaking bad words to others, Allah is not in need of his (fasting) leaving his food and drink.” [bukhari] 9. Do not eat too much after Iftar. 10. Ask for forgiveness since this is the month Allah frees people from the fire. 11. Perform Taraweeh Salah with Khushoo in the masjid. 12. Get a bit earlier at suhoor and perform Tahajjud salah. Prolong the Salah as long as you can. 13. Feed the poor and invite others for Iftar. The Prophet peace be upon him said, “Whoever gives Iftar to someone fasting he will have the same reward without decreasing the reward of the person fasting”. 14. Try harder the last ten nights especially the odd nights. The prophet would strive in Ramadan more than he would in any other month and more so in the last ten days. 15. Say this Dua in the nights that Laitul-Qadr is likely to fall on: Allhumma innaka afuwun tuhibbul-afwa fa’fu anni (O Allah you are Forgiving and love forgiveness so forgive me). 16. Ask Allah to accept all your good actions during this month. O you who believe, fasting is decreed for you, as it was decreed for those before you, that you may attain salvation.   5. Have you ever wondered why it is difficult to concentrate in your prayer? Or why your faith throughout the year is not on a high like it is during Ramadan or through Hajj? Maybe it is because we usually jump straight from a phone conversation into Takbir or because we just go with the flow in Ramadan and are influenced by the environment around us and not our own ‘real’ feelings. A lot of us usually live life and have our faith dependent on an upcoming major event i.e. “I’m going to start reading a page of Quran a day as soon as Ramadan starts; I’m going to start praying Qiyam every night when I come back from hajj; or, I’m going to stop smoking when my child is born.” And because of this way of thinking we usually end up with an anticlimax; we don’t end up giving up smoking, we don’t end up praying Qiyam and we start reading Quran but then get back to our normal old self after a few days or weeks. This is because these ‘statements’ or ‘feelings’ are based on impulse and not a real thought out plan. We usually don’t prepare for Ramadan or hajj or have a plan for our faith to stay at the increase; we just go with the flow and expect it all to happen. Well, it doesn’t! Wouldn’t you love to enter the month of Ramadan on a real high and have the effects of this beautiful month be a permanent impact on your life thereafter? How can this be done? Below are the 8 steps for a Legacy of a Ramadan. Step 1 – Create a Ramadan Count DownCounting down for Ramadan (whether it is done mentally or by keeping physical signs around the home or office) will help create hype and buzz in your mind and amongst the people around you. When you and others are counting down to the same event, it becomes part of regular conversation and excitement spreads. Step 2 – Seek knowledge about RamadanThis will help you ensure you will do things correctly and perfectly for Ramadan, it will create a hype as there are many motivational aspects and events in the month to look forward to and finally it is a reward reaper. The more you know about Ramadan the more you can apply, hence multiplying your rewards. Step 3 – Make a Ramadan planBe it reading the entire Quran, ensuring you pray taraweeh every night or inviting families over for iftaar; make a list of things you would like to achieve in the month and then how you plan on achieving these goals. It is important that goals are realistic and it is better that your life doesn’t need to entirely take a different road in this month (i.e. take the month off work or change work hours etc.) so that you may continue to do these deeds after Ramadan. Knowing what you want to achieve in the month will help you stay focused. Ensure you plan your day every night before you sleep when Ramadan starts (try to continue this even after Ramadan). Step 4 - Know your lifeBe aware if Ramadan affects anything that is happening in the month or shortly after. Do you have exams during Ramadan? Or is there a major family wedding after Ramadan by a short time? Moving house? If so, plan for these events from now. Study now so that you are prepared for the exams before the month starts. Be packed and ready to go before Ramadan or plan that you do it after so that it doesn’t take time away from your worship. The last thing you want to do is spend Ramadan at the shopping centres. Buy any Eid presents and prepare for any wedding before the month starts. Step 5 – Prepare spirituallyWe all know that Ramadan is about Fasting, Praying, Reading Quran and giving in charity. Start these worships early; don’t expect to just click into it as soon as the first day of Ramadan starts. Start doing extra prayers from now, start revising and regularly reading Quran now, get used to being generous and follow the Sunnah of the Prophet Muhammad (peace and blessings of Allāh be upon him) and fast during Sha’baan. Step 6 – Prepare your mindFasting is to refrain from more than just what we consume in our mouth. Start working on your patience; be extra vigilant with your conversations: ensure you are not backbiting, slandering or talking about useless things. Step 7 – Say ‘good riddance’ to bad habits Know what bad habits you have and stop them from now, don’t wait until Ramadan begins. If you sleep late, start sleeping early, if you are a Facebook junky start cutting down, have a coffee craze, slow it down etc. It might sound much easier said then done, but once you’ve committed yourself, purified your intentions – make sincere dua for guidance. Insh’Allah, these bad habits will be easier done with than you ever expected. Step 8 – Plan your life around your worshipFor instance; instead of working through your prayer or setting up meeting etc., at prayer times, plan that you have a break at prayer time.   6. 12 Tips for the Convert Muslim By a Muslim Convert in America 1. Practice Islam as much as you can “He who loves my Sunnah has loved me, and he who loves me will be with me in Paradise.” -The Prophet Muhammad ﷺ (Tirmidhi) As a new Muslim, you will have trouble keeping up with prayers every day, fasting during Ramadan, and the many other practices in this religion. The struggle that we face, with such a radical change in lifestyle, is difficult and will take some time. Awkward moments are bound to happen, don’t fret. You are not expected to wake up at 4am every morning to pray tahajjud (extra night prayers). If you have problems with certain practices, then gradually work yourself into the mindset of worship. A counselor once told me when I was young, “How do you eat an elephant? Just One bite at a time.” Think of it as one step at a time. Pray to Allah (swt) and ask for Him to make it easy for you and the rest will come naturally. Keeping up with your devotional practices is something that will strengthen your faith immensely. Read the Qur’an whenever possible. Find a collection of hadith, such as Riyadh us-Saliheen, and read it often. You will start to feel a connection to Allah (swt) and you will become used to Islam as a religion and way of life. 2. Respect your parents “Heaven lies under the feet of your mother.” -The Prophet Muhammad ﷺ (Ahmad, Nasa’i) Keeping up a good relationship with your family is essential. Try to avoid bringing up or taking part in controversial subjects regarding religion. This is almost unavoidable, but your parents will eventually accept that Islam is not going to turn you into a terrorist if you stay calm during these tense moments. Gradually, your parents will gain some respect and understanding of Islam and may start to become genuinely interested. This is a great sign and insha’Allah, God will make a way for them to accept Islam. What you do not want to do is act like you know everything, attempt to debate everything, or overly defend yourself in a way that might make you angry or upset. This will just cause heartache and uneasiness. Your priority now should be to work on yourself. 3. Find a teacher “For him who follows a path for seeking knowledge, Allah will ease for him the path to Paradise.” -The Prophet Muhammad ﷺ (Muslim) Finding a teacher to bounce ideas off of is a great way to learn your deen (religion). I found it is good to find someone with as much knowledge as possible who also has an understanding of the English language and American culture. It is difficult to listen to someone with a thick accent or someone with a back-home mentality. When I first accepted Islam, I would drive every day to visit my teacher and I would ask him what seemed like an endless stream of questions. Sometimes he seemed overwhelmed! This is a great way to clarify things you hear on Sheikh Youtube or Google or any part of the Qur’an you are reading at the time. This will also help you have a real grounding in the Islamic tradition. You will eventually have spent more time learning Islam than most people from Muslim families. Maintain a sense of humility if you do gain a lot of knowledge, as there will always be someone who will be more knowledgeable than you. Learn everything you can in small chunks, no one is asking you to be a scholar! 4. Keep away from debates and arguments “Verily anger spoils faith as aloe spoils honey.” -The Prophet Muhammad ﷺ (Abu Dawud, Tirmidhi) Trying to constantly defend your religion is something that will cause you a lot of stress. I remember when I first accepted Islam, it seemed like the whole world was after me. This may happen to different people at different levels, but it was a very overwhelming experience for me. The best thing to do is avoid these arguments at all costs. If you are mature about your religion and display a desire to explain yourself without refuting others, then many doors will open for you. You are bound to give someone a refreshing view of Islam, which is what so many people are hungry for after seeing Islam in such a negative light in the media. Staying away from these discussions will put you at peace and give you breathing room. A lot of converts are not really comfortable with bringing up their religion because of the backlash they receive. Personally, I recognized that if I just mention it when necessary, I get a more positive reaction. You’ll be surprised to hear “Oh that’s cool dude, what made you pick that religion?” This is always an opportunity for da’wah (inviting to Islam). 5. Gain a connection to the Arabic language “Indeed, We have sent it down as an Arabic Qur’an that you might understand.” -The Holy Qur’an, 12:2 This is one of my favorite parts of becoming a Muslim. To be honest, I’m a language-lover and I realize everyone is not the same in this regard. Just because you failed high school Spanish though doesn’t mean you will have trouble with Arabic. There are many tricks to learning the language that I won’t go into here, but there are ways to make this easier on yourself. These methods can be found online or in books; with a little research you can pave your way to gaining an understanding of Arabic. Start by learning the alphabet and connecting letters together. You can learn this in an afternoon if you know someone that is a native Arabic speaker (but go at your own pace). Sit on that for a while and eventually you will be able to follow along in the Qur’an if you listen to a recitation on your computer or MP3 player. You will start to recognize words, after which you can get into simple grammar rules. I recommend learning common nouns and prepositions first (words like “in”, “on”, “for” and “with”). Arabic can be really enjoyable, and you are bound to gain an Islamic vocabulary after listening to talks or lectures. Eventually you will know meanings of words like “furqaan” and “sajdah” and you’ll be able to use them in conversations with Muslims. Sabr (patience) is essential! 6. Understand Islam’s organic nature “Those who make things hard for themselves will be destroyed. (He said it three times.)” -The Prophet Muhammad ﷺ (Muslim) Coming to Islam will sometimes put you in a situation where you are overwhelmed with opinions that are hard to follow. As an example, one might be told that you have to wash your feet every time you make wudhu (ablution) unless you wipe over leather socks that have been worn from your previous wudhu. For most Americans, the idea of wearing leather socks is something that we find extremely unusual. If we do a little research, we find there are opinions of scholars that mention the permissibility of wiping over cotton socks (even ones with holes in them!). To an American convert, these opinions can cause a huge sigh of relief. 7. Maintain your Identity “O mankind, indeed We have created you from male and female and made you peoples and tribes that you may know one another. Indeed, the most noble of you in the sight of Allah is the most righteous of you. Indeed, Allah is Knowing and Acquainted.” -The Holy Qur’an, 49:1 Being a Muslim is a huge part of your identity now. That doesn’t mean you can’t barbeque with your friends or watch football on Sundays. If there are things in your culture that do not directly contradict with basic Islamic creed, then you are welcome to keep those things in your life. You do not need to start wearing Arab or Indian clothing. As long as your clothes cover what they are supposed to cover, you are in the clear. Many converts are also exposed to really weird food that is overly spicy or funny tasting. This might lead us to think that eating curry is sunnah or something righteous. We can still have our own culture and tastes in food: pot roast and beans are still halal! There are many other examples of things that you will be exposed to that are from foreign cultures and do not necessarily have anything to do with Islam. Our goal as new Muslims is to worship Allah (swt), not to add a Pakistani or Arab identity to our persona. It is good to have a teacher who understands the subtleties of different opinion in fiqh (Islamic jurisprudence) and can inform you of differences among the scholars on issues that are of concern. Most people in masajid will have a very limited view of the juristic possibilities inside the Islamic tradition. Islam is a vast tradition and we should not make it small. These diverse opinions are there to help us, not cause strain on ourselves. 8. Force yourself to go to the masjid “The person who receives the greatest reward for the Salah is one who lives the farthest and has the farthest to walk.” -The Prophet Muhammad ﷺ (Bukhari, Muslim) Going on Fridays is a given, but I would also recommend trying to fit a few prayers (at least) per week in the masjid. This will open many doors for you and will insha’Allah grant many good deeds to your account. You will meet people who are connected to Islam; networking opportunities are more readily available; and you are bound to make long-lasting friends. This is one of the things that I really love about Islam, that you can almost always find people in the masjid. Although this may be hard initially, try and go to the masjid. The payoff will be huge, even if you just pray and leave right after. You will eventually warm up to the community and you can feel more comfortable going to the masjid whenever you like. 9. Find Muslim friends and avoid severing ties “On the Day of Resurrection Allah Almighty will proclaim: “Where are those who have mutual love for My Glory’s sake? Today I shall shelter them in My shade where there is no shade but Mine.” -The Prophet Muhammad ﷺ (Muslim) Saying “As-salamu ‘Alaykum” ( “Peace be upon you”) to people you see on campus or at the grocery store is a real blessing in Islam. It immediately lets people know you are Muslim and they usually will be happy to return the greeting and hopefully share a few words with you. Doors of friendship will be opened and you will meet lots of people. Try and spend some time with Muslims when you can. It is beneficial to remind yourself that you are not the only Muslim on the planet and you share your religion with almost 2 billion people around the globe. Also, don’t sever your friendships with your non-Muslim friends unless they are constantly partying or using the list of major sins as their weekend to-do list. You can be a light to your Christian, Agnostic, Jewish, or Atheist friends. You never know who Allah (swt) will guide, and showing that you are living an ethical life can encourage these people to learn a little about Islam or change their mind to having a positive view of the religion. 10. Avoid Loneliness “Islam began as something strange and will revert to being strange as it began, so give glad tidings to the strangers.” -The Prophet Muhammad ﷺ (Muslim) This is a major problem in the convert community. We are lonely. The best thing we can do to fight the feeling of loneliness is to spend as much time as possible with good company. Having dinners with people a few nights a week is a sure way to maintain a good attitude. The practice of becoming a nun or a monk is alien to Islam; we are social creatures and Islam recognizes this. Try not to lock yourself away in your apartment to avoid the world. This will just cause a vicious cycle that will cause deep depression and can lead to searching for solace in haram (unlawful). Make it an obligation on yourself to remain a sociable human being. It takes a lot of work but the result is happiness and contentment in life. 11. Stay away from extremism “And thus we have made you a just community that you will be witnesses over the people.” -The Holy Qur’an, 2:143 Most converts do not enter Islam looking for an extremist point of view. Unfortunately, we have seen some converts do end up overseas working for terrorist organizations. This is something that can happen from a person feeling victimized or ostracized by their own culture and being overcome with anger. I personally have not had a problem with anyone trying to “radicalize” me. It does happen enough though that it should be a concern. It will be best for you to keep your head on your shoulders and not get caught up with extreme points of view. Know that all of the scholars overseas and in America have absolutely refuted terrorism in their fatawa (legal rulings). Extremism is on the very edges of the Islamic thought. Do your best to stay on a middle way. 12. Do not despair “So know that victory is with patience, and relief is with distress and that with hardship comes ease.” -The Prophet Muhammad ﷺ Being a convert to Islam, you will face a lot of tribulations. There is not anything that you cannot overcome though, and never despair in Allah (swt). Allah (swt) guided to you to Islam, you searched for the answer and you found it. Be happy and constantly remind yourself of the blessings in your life. There are a lot of good things that will happen to you and you are on the straight road to Jannah (paradise). Rejoice in being Muslim. Remember the Sahabah (companions) were all converts to Islam and they were human beings that came from Adam and Eve just like you! Be strong and find comfort in your prayers and worship to Allah (swt). A student spends years studying, however if his methodology is inaccurate and imprecise, then he will fail in gaining maximum benefit. The acquisition of knowledge requires three dimensions: 1) Abstinence from sin. 2) Constant, persistent and unceasing effort. 3) Retaining and preserving what was studied. 1) Abstinence from sin As opposed to all sciences, the Islamic sciences are fused with spirituality and Allah consciousness. The stronger the bond with Allah, the greater the understanding of the Islamic sciences. The level of one’s Iman, actions and connection with Allah contribute to one’s knowledge. Knowledge of the Islamic sciences brings with it a huge responsibility. One who is well grounded in the dictates of Shari’ah has the task to promote truth and vanquish falsehood. To identify the truth as the truth and falsehood as falsehood, one needs to gaze at life with eyes immersed in Allah’s recognition. If one is not acquainted with Allah, he will be bereft of the divine light to guide him through the dark challenges of life. Such qualities can only come with abstinence from sin. The underlying reason is that the Islamic sciences are not there simply to be ‘known’; the Islamic sciences are there to establish a civilisation based on truth, morals, ethics and principles. The purpose of learning is implementation. 2) Constant effort Now coming onto how to acquire the Islamic sciences, the game plan is one: one has to punch above one’s weight. Greatness cannot be achieved by comfort. Greatness has locked horns with comfort and luxury. They are at loggerheads with one another. The two cannot go hand in hand. A student cannot reach the heights of the great scholars whilst sleeping eight hours a day, eating three course meals and playing Playstation. That’s a fact. Greatness demands great sacrifice. Greatness is not elusive; all of us can achieve it. Knowledge demands a die-hard attitude. If a student understands this, he is one step away from success. A student should do the following: a) PREVIEW Spend at least 15-30 minutes a day previewing the upcoming lesson. He needs to become familiar with what he will study in the next lesson. At the same time, he should try and understand whatever he can whilst browsing through. Whatever is easy, he will understand right away. Whatever is challenging, he should mark that text. This will make him more focussed when listening to the commentary of that text from his teacher. b) LISTEN How many students are there in class but not there? Physically they are in a lesson but mentally they are touring the world! It is of utmost importance to stay mentally present. A student needs to listen to the lecture of his teacher very attentively. He needs to listen and capture the words of his teacher on paper. Whatever he marked out whilst previewing his lesson, he needs to be all ears at such places. c) QUESTION A weakness in many students today is the inability to engage with the teacher. Whatever the student has not understood should be ask to his teacher in a very respectable manner. A teacher is there to quell misunderstandings. One must ask his teacher if he has failed to understand. There is no room to be shy or embarrassed. As the famous saying of one of our pious predecessors states, “A shy person and a proud person can never gain knowledge.” If a person does not ask, that question will always remain. He will never be confident on the issue. An important point we need to understand here is to be observant. At times the teacher is in a hurry or wants to finish a particular paragraph. Ask and engage the teacher when the teacher shows his readiness to accept questions. Many a time, a teacher mentions something and a student starts interrupting whilst the lesson is taking place. Even worse, at times the question posed by the student is answered in the book itself in the next sentence. Some teachers are ready to accept questions after a paragraph whilst others prefer at the end of the lesson. Every student should be mindful of his teacher’s preferences. d) REVIEW Once the day comes to an end for the world, the day just begins for a student! He has the whole night at his disposal. A student must sit daily to review today’s lesson and master its contents. The student needs to preview and review at fixed times. He should accustom himself to a timetable. Everything should have an allocated time. The more a student nails himself to a schedule, the more he will progress. 3) Retention Retention is probably one of the most important dimensions in acquisition. The science of logic (mantiq) defines knowledge as, “That which is present in the mind.” Whatever is not in the mind, is not known, hence it is not knowledge. Therefore, a student must memorise as much as he can. How many times are we discussing something we read the night before but cannot recall what we read? The problem is we do not know how to retain information! Is this substantiated from any Hadith? Answer In essence, your question is about whether the deceased is inconvenienced by the sins of those who survive him/her. There are several Hadiths that explain that our deed are shown to the deceased from time to time, and they take effect from what we are doing; if its good that the living are involved in, then the deceased will take good effect, and vice-versa. Hereunder are some of those Hadiths: 1. In a sound (hasan) Hadith recorded by several Muhaddithun, like Ibn Abi Khaythamah, Ibn Abi Shaybah, Tabarani and others (rahimahumullah), Rasulullah (sallallahu’alayhi wasallam) said: ‘… By the oath of Allah, some of you cry, which results in the deceased crying too. O slaves of Allah! do not punish your deceased [like this].’ (See Fathul Bari, Hadith: 1286) 2. Imam Ibn Jarir Tabari (rahimahullah) has authentically recorded from Sayyiduna Abu Hurayrah (radiyallahu’anhu) that he said: ‘Indeed the deeds of the living are shown to their deceased relatives.’ (See Fathul Bari, Hadith: 1286) 3. Sayyiduna Anas (radiyallahu’anhu) reports that Rasulullah (sallallahu’alayhi wasallam) said: ‘ Indeed your actions are shown to your deceased family and friends, and they rejoice at the good [that you do]. If they are shown your sins, they say: ‘O Allah! Grant them guidance till death, like you did for us.’ (Musnad Ahmad, vol.3 pg.165) 4. Sa’id ibn Musayyab (rahimahullah) once said: ‘The deceased is informed of the deeds of everyone of his family and friends. Being called while performing Salaah Q: If a person is performing Zuhr Salaah at home and a family member calls him from another room, what is the best way to notify the family member that he is in Salaah? Is it ok for him to recite his qira'ah loudly for 1-2 seconds to show that he is praying (even if it is Zuhr Salaah), or should he say "subhaanallah" loudly or is there any better way? A: If there is no emergency, then he should not break his Salaah. However, he may recite subhaanallah audibly to inform them that he is in Salaah. Q: If a person is performing Sunnats or Nawaafil Salaah and is finishing the sajdah of the third rakaat as the iqaamat goes, should he cut the salaah short and make it three rakaats and finish the two later or should he complete the four rakaats and miss the Takbeer-e-ula? ( والشارع في نفل لا يقطع مطلقا ) ويتمه ركعتين ( وكذا سنة الظهر و ) سنة ( الجمعة إذا أقيمت أو خطب الإمام ) يتمها أربعا ( على ) القول ( الراجح ) لأنها صلاة واحدة وليس القطع للإكمال بل للإبطال خلافا لما رجحه الكمال قال الشامي : قوله ( خلافا لما رجحه الكمال ) حيث قال وقيل يقطع على رأس الركعتين وهو الراجح لأنه يتمكن من قضائه بعد الفرض ولا إبطال في التسليم على الركعتين فلا يفوت فرض الاستماع والأداء على الوجه الأكمل بلا سبب اه أقول : وظاهر الهداية اختياره وعليه مشى في الملتقى ونور الإيضاح والمواهب وجمعة الدرر والفيض وعزاه الشرنبلالية إلى البرهان وذكر في الفتح أنه حكي عن السعدي أنه رجع إليه لما رآه في النوادر عن أبي حنيفة وأنه مال إليه السرخسي والبقالي وفي البزازية أنه رجع إليه القاضي النسفي وظاهر كلام المقدسي الميل إليه ونقل في الحلية كلام شيخه الكمال ثم قال وهو كما قال هذا وما رجحه المصنف صرح بتصحيحه الولوالجي وصاحب المبتغى والمحيط ثم الشمني وفي جمعة الشرنبلالية وعليه الفتوى قال في البحر والظاهر ما صححه المشايخ لأنه لا شك أن في التسليم على الركعتين إبطال وصف السنية لا لإكمالها وتقدم أنه لا يجوز ويشهد لهم إثبات أحكام الصلاة الواحدة للأربع من عدم الاستفتاح والتعوذ في الشفع الثاني إلى غير ذلك كما قدمناه اه وأقره في النهر أقول : لكن تقدم في باب النوافل أنه يقضي ركعتين لو نوى أربعا وأفسده وأنه ظاهر الرواية عن أصحابنا وعليه المتون وأنه صحح في الخلاصة رجوع أبي يوسف إليه وصرح في البحر أنه يشمل السنة المؤكدة كسنة الظهر حتى لو قطعها قضى ركعتين في ظاهر الرواية وأن المشايخ من اختار قول أبي يوسف في السنن المؤكدة واختاره ابن الفضل وصححه في النصاب وقدمنا هناك أن ظاهر الهداية وغيرها ترجيح ظاهر الرواية فحيث كانت المتون على ظاهر الرواية من أنه لا يلزمه بالشروع في السنن إلا ركعتان لم تكن في حكم صلاة واحدة من كل وجه ولم يكن في التسليم على الركعتين إبطالا لها وإبطال وصف السنية لما هو أقوى منه مع إمكان تداركها بالقضاء بعد الفرض لا محذور فيه فتدبر ثم اعلم أن هذا كله حيث لم يقم إلى الثالثة أما إن قام إليها وقيدها بسجدة ففي رواية النوادر يضيف إليها رابعة ويسلم وإن لم يقيدها بسجدة قال في الخانية لم يذكر في النوادر واختلف المشايخ فيه قيل يتمها أربعا ويخفف القراءة وقيل يعود إلى القعدة ويسلم وهذا أشبه ا هى قال في شرح المنية والأوجه أن يتمها لأنها إن كانت صلاة واحدة فظاهر وإن كانت كغيرها من النوافل كل شفع صلاة فالقيام إلى الثالثة كالتحريمة المبتدأة وإذا كان أول ما تحرم يتم شفعا فكذا هنا ا ه (رد المحتار 2/ 53) فتاوى محمودية 11/ 261 Answered by: Mufti Zakaria Makada Checked & Approved: Mufti Ebrahim Salejee (Isipingo Beach)

  13. Procedure for asking the husband for a divorce Q: Kindly explain the rules of a woman asking for a divorce. A: One should adopt all halaal means and ways in trying to resolve the marital disputes and misunderstandings. If one is able to speak to one's husband directly and thereby reach some resolution in amicably settling the marital problems, then one should do so. If this is not possible, then one should refer the matter to a third person or a third party and ask them to assist in bringing about a reconciliation. If reconciling is not possible and the wife is sure that she cannot manage to continue with the nikaah and she knows that later on she will not have any regrets over her decision, then she may seek talaaq from her husband.   14. Q: A family moves into an apartment, they use a well known Qibla finding app to locate the Qibla direction and pray. Months later a neighbour points out that the direction is wrong and they must face the other direction. The difference is about 90 degrees apart. What happens to those Salaah that were prayed in the incorrect direction, are they valid or do they need to be repeated? A: If it can be confirmed that the direction was definitely wrong through some reliable means and the direction was 90 degrees away from the qiblah, then the namaaz must be repeated. And Allah Ta'ala (الله تعالى) knows best. ل المفهوم مما قدمناه عن المعراج والدرر من التقييد بحصول زاويتين قائمتين عند انتقال المستقبل لعين الكعبة يمينا أو يسارا أنه لا يصح أو كانت إحداهما حادة والأخرى منفرجة بهذه الصورة والحاصل أن المراد بالتيامن والتياسر الانتقال عن عين الكعبة إلى جهة اليمين أو اليسار لا الانحراف لكن وقع في كلامهم ما يدل على أن الانحراف لا يضر ففي القهستاني ولا بأس بالانحراف انحرافا لا تزول به المقابلة بالكلية بأن يبقى شيء من سطح الوجه مسامتا للكعبة وقال في شرح زاد الفقير وفي بعض الكتب المعتمدة في استقبال القبلة إلى الجهة أقاويل كثيرة وأقربها إلى الصواب قولان الأول أن ينظر من مغرب الصيف في أوطل أيامه ومغرب الشتاء في أقصر أيامه فليدع الثلثين في الجانب الأيمن والثلث في الأيسر والقبلة عند ذلك ولو لم يفعل هكذا وصلى فيما بين المغربين يجوز وإذا وقع خارجا منها لا يجوز بالاتفاق ا هـ ملخصا وفي منية المصلي عن أمالي الفتاوى حد القبلة في بلادنا يعني سمرقند ما بين المغربين مغرب الشتاء ومغرب الصيف فإنه صلى إلى جهة خرجت من المغربين فسدت صلاته ا هـ وسيأتي في المتن في مفسدات الصلاة أنها تفسد بتحويل صدره عن القبلة بغير عذر فعلم أن الانحراف اليسير لا يضر وهو الذي يبقى معه الوجه أو شيء من جوانبه مسامتا لعين الكعبة أو لهوائها بأن يخرج الخط من الوجه أو من بعض جوانبه ويمر على الكعبة أو هوائها مستقيما ولا يلزم أن يكون الخط الخارج على استقامة خارجا من جهة المصلى بل منها أو من جوانبها (رد المحتار 1/427-428) فلو فرض مثلا خط خطا من تلقاء وجه المستقبل للكعبة على التحقيق في بعض البلاد وخط آخر يقطعه على زاويتين قائمتين من جانب يمين المستقبل وشماله لا تزول تلك المقابلة بالانتقال إلى اليمين والشمال على ذلك الخط بفراسخ كثيرة ولهذا وضع العلماء قبله بلد وبلدين وبلاد على سمت واحد (البحر الرائق 1/ 300) وعن أبي حنيفة المشرق قبلة أهل المغرب والمغرب قبلة أهل المشرق والجنوب قبلة أهل الشمال والشمال قبلة أهل الجنوب وعليه فالإنحراف القليل لايضر اه (جواهر الفقه نقلا عن الفتاوى الخيرية 1/255) وفي الفتاوى الخيرية تحت قوله (سؤل) ومن القواعد الفلكية إذا كان الإنحراف عن مقتضى الأدلة اكثر من خمس وأربعين درجة يمنة أو يسرة يكون ذلك الإنحراف خارجا عن جهة الربع الذي فيه مكة المشرفة من غير إشكال (إلى) فهل هذه المحاريب التي إنحرافها كثير فاحش يجب الإنحراف فيها يسرة إلى جهة مقتضى الأدلة والحالة ما ذكرنا ام لا – وإذا قلتم يجب فهل إذا عاندى شخص وصلى في هذه المحاريب بعد اثبات ما ذكرنا تكون صلاته فاسدة الخ (اجاب) حيث زالت بالإنحراف المذكور المقابلة بالكلية بحيث لم يبق شيء من سطح الوجه مسامتا للكعبة عدم الاستقبال المشروط لصحة الصلاة بالاجماع وإذاعدم الشرط عدم المشروط (جواهر الفقه نقلا عن الفتاوى الخيرية 1/256-257) Answered by: Mufti Ebrahim Salejee (Isipingo Beach)

As Muslims, we are commanded to refrain from emulating the kuffaar as well as adopting their ways. Nabi (Sallallahu Alaihi Wasallam) said من تشبه بقوم فهو منهم (the one who emulates a people will be counted from amongst them (in the sight of Allah Ta’ala)). عن ابن عمر قال قال رسول الله صلى الله عليه وسلم من تشبه بقوم فهو منهم. (سنن أبي داود رقم 4033)​ من تشبه بقوم أي من شبه نفسه بالكفار مثلا في اللباس وغيره أو بالفساق أو الفجار أو بأهل التصوف والصلحاء الأبرار فهو منهم أي في الإثم والخير. Please advise me what I should do in this situation. A: Committing suicide is haraam in Islam. It will not save one from the difficulty and hardship one is experiencing, instead it will only increase one's agony and pain. The one who gives up hope in life and takes his life by committing suicide is in actual fact jumping from the frying pan into the fire. He is trying to save himself from the trivial worldly hardships through killing himself, but becomes deserving of the wrath of Allah Ta’ala and the severe punishment of the hereafter. We advise you to refer to some pious, experienced Aalim or Sheikh and seek advice and Deeni guidance from him. ( إمساك عن المفطرات ) الآتية ( حقيقة أو حكما ) كمن أكل ناسيا فإنه ممسك حكما ( في وقت مخصوص ) وهو اليوم قال شامي : قوله ( وهو اليوم ) أي اليوم الشرعي من طلوع الفجر إلى الغروب وهل المراد أول زمان الطلوع أو انتشار الضوء فيه خلاف كالخلاف في الصلاة والأول أحوط والثاني أوسع كما قال الحلواني كما في المحيط والمراد بالغروب زمان غيبوبة جرم الشمس بحيث تظهر الظلمة في جهة الشرق قال صلى الله عليه وسلم إذا أقبل الليل من هاهنا فقد أفطر الصائم أي إذا وجدت الظلمة حسا في جهة المشرق فقد ظهر وقت الفطر أو صار مفطرا في الحكم لأن الليل ليس ظرفا للصوم وإنما أدى بصورة الخبر ترغيبا في تعجيل الإفطار كما في فتح الباري قهستاني (رد المحتار 2/ 371) Answered by: Mufti Zakaria Makada Checked & Approved: Mufti Ebrahim Salejee (Isipingo Beach)

  19. Q: Who will be a representative of a revert Muslim women. All her family, parents, etc are non Muslim. A: If she does not have a Muslim guardian then some senior from the community may represent her with her consent. However, the representation will not make the senior a mahram to her.   20. Reciting Dua-Qunoot loudly Q: If one recites dua-e-qunoot loudly, will the salaah be valid? A: The dua-e-qunoot should be recited softly. However if it was recited loudly, the Salaah will be valid. And Allah Ta'ala (الله تعالى) knows best. (وقنت فيه) ويسن الدعاء المشهور ... (مخافتا على الأصح مطلقا) ولو إماما، لحديث خير الدعاء الخفي. قال الشامي: (قوله على الأصح) كذا في المحيط. وفي الهداية أنه المختار، ومقابله ما في الذخيرة واستحسنوا الجهر في بلاد العجم للإمام ليتعلموا، وفصل بعضهم بين أن يعلمه القوم فالأفضل للإمام الإخفاء وإلا فالجهر. اهـ. قلت: هذا التفصيل لا يخرج عما قبله. وفي المنية من اختار الجهر اختاره دون القراءة. (قوله ولو إماما) قال في الخزائن إماما كان أو مؤتما أو منفردا، أداء أو قضاء، في رمضان أو غيره.   21. Reciting more than one Surah in a single rakaat of a Fardh or Nafl Salaah Q: Is it permissible to recite two or more Surahs consecutively in a single rakaat of a Fardh or Nafl Salaah? A: One should avoid reciting more than one Surah in a single rakaat of a Fardh Salaah. However one may recite more than one Surah in a single rakaat of Nafl Salaah if one wishes. And Allah Ta'ala (الله تعالى) knows best. قال الشامي : قوله ( ويكره الفصل بسورة قصيرة ) أما بسورة طويلة بحيث يلزم منه إطالة الركعة الثانية إطالة كثيرة فلا يكره شرح المنية كما إذا كانت سورتان قصيرتان وهذا لو في ركعتين أما في ركعة فيكره الجمع بين سورتين بينهما سور أو سورة فتح وفي التاترخانية إذا جمع بين سورتين في ركعة رأيت في موضع أنه لا بأس به وذكر شيخ الإسلام لا ينبغي له أن يفعل على ما هو ظاهر الرواية ا ه وفي شرح المنية الأولى أن لا يفعل في الفرض ولو فعل لا يكره إلا أن يترك بينها سورة أو أكثر (رد المحتار 1/ 546) والجمع بين سورتين بينهما سور أو سورة في الخلاصة لا يكره هذا في النفل قال الطحطاوي : قوله ( والجمع بين سورتين الخ ) أي في ركعة واحدة لما فيه من شبهة التفضيل والهجر (حاشية الطحطاوي على مراقي الفلاح ص 352) فتاوى محمودية 10/ 496 Answered by: Mufti Zakaria Makada Checked & Approved: Mufti Ebrahim Salejee (Isipingo Beach)
